Price

All prices are net prices. There are no hidden packing or handling charges. Only shipping charges apply (see shipping charges). The ordered items are shipped upon receipt of your payment. Local customs taxes may apply in some countries.

Exchange rates

The exchange rate shown on our site is for information purposes only. In the case of transactions in foreign currencies, only the CHF is authoritative (final transactions when the cart is released are in Swiss francs).

Quality

EVERY BOX IS OPENED AND CHECKED BEFORE SHIPPING. Boxes are hermetically sealed to preserve the cigars' humidity during transit (do not keep hermetically sealed on receipt ).

Quality complaints are accepted within 5 days after receipt of the goods. In case of apparent defects, the defective parts will be replaced, subject to verification of the alleged defects.

Shipping charges

All cigars are shipped in neutral boxes with no label. Shipping charges are flat rates from the Swiss post. The shipping is free for all order above CHF 300.-.

WE DO NOT SHIP CUBAN CIGARS TO THE UNITED STATES. We do not ship tobacco to France, to French overseas territories and Belgium.

Quantity

There is no minimum order.

Delivery time & Refund policy

For Switzerland :

A. Shipping & delivery: postal shipment within 48 hours - as long as the merchandise is in stock - upon receipt of payment. For express orders, delivery is made the next day, provided that the order was placed before 4pm (and that the merchandise is in stock).

B. Refund policy: if the merchandise is not delivered within 5 days, we will initiate a detailed enquiry with the Swiss Post.

- If the parcel is lost, we will return the merchandise or refund the money within 5 days, using the same method of payment used for the order.

- If the parcel is returned to us, we will send back the goods or we will proceed to the refund within 5 days, with the same method of payment used at the time of the order.

For the international :

A. Shipping & delivery: postal shipment within 48 hours - as long as the merchandise is in stock - upon receipt of payment. The merchandise is delivered within 10 to 20 days, depending on the destination country.

B. Refund policy: If the merchandise is not delivered within 30 days, we launch a detailed inquiry with the Swiss Post.

- If the parcel is identified and returned to us, we will send the merchandise back or proceed to a refund within 5 days, using the same method of payment used when the order was placed.

- If the parcel cannot be found after 8 weeks: we will send the merchandise back or reimburse you within 5 days, using the same method of payment used for the order.

Payment & Methods of payment

Taxes are included in our prices.

The articles can be paid :

- in advance by postal transfer (account no. 12-728428-6)
- cash on delivery (additional costs: CHF 18.-, for Switzerland only)
- by Twint
- by credit cards: Mastercard and Visa (secure system SaferPay from Telekurs cards solution), AMEX, UnionPay
- By Postcard

Customer's responsibility

Responsibility for the items is transfered to the customer after the delivery slip has been signed, even if delivery took place in a different place than the usual delivery place. Customs taxes may apply in some countries. The customer assumes all responsibilities for payments of duties and taxes. You agree to accept your package and pay the customs fees. If you refuse, we will deduct the actual shipping costs from the refund.

Export Control

You agree to comply with all export control laws. You warrant that you are not located in, under the control of, or a national or resident or any country to which the export of the products is prohibited by applicable export control laws. We DO NOT sell cuban cigars to USA & US residents. 

Delay in withdrawal/pre-payment

In case the customer does not withdraw/accept the goods within 30 days, Thecigar.com reserves the right to terminate the contract and to claim damages for failure on the customer's part to respect the contract. Thecigar.com has the right to chose between the reimbursement of 25% of the amount of the invoice or the real amount of the damage undergone. This provision shall not apply in cases where neither the customer nor Thecigar.com's responsibility is involved (ex.: if goods get lost by postal services).

Return & cancellation policy

- The return policy and cancellation policy is 14 days from the day the buyer receives the merchandise.

- Merchandise delivered in error or in excess must be returned to the seller within 14 days.

- The merchandise must be returned undamaged, in its original packaging and per packaging unit.

- The shipping costs are to be assumed by the buyer.

- The buyer assumes the direct costs and risks of returning the merchandise.

- The refund will be made with the same method of payment used at the time of purchase.

A. Replacement of merchandise:

- If the buyer is not satisfied with the quality of the product when ordering and we can understand the quality defect, it will be replaced ;

- In this case, the buyer must contact us within 14 days to get the return authorization before sending the merchandise back;

- Once the approval is received, the buyer can send the contested product back at his own expense;

- After receiving the merchandise, we check whether the return conditions are met and whether the merchandise is undamaged;

- If the return conditions are met, we will send the replacement merchandise to the buyer;

B. Refund policy following a cancellation policy:

- If the buyer is not satisfied with the quality of the product and does not wish to keep the merchandise, the seller will refund the buyer;

- In this case, the buyer must contact us within 14 days to obtain the return authorization before sending the merchandise back;

- Once the agreement is received, the buyer can send back the contested product at his own expense;

- After receiving the merchandise, we check if the return conditions are met and if the merchandise is not damaged;

- If the return conditions are met, we will refund the purchase price to the buyer within 5 days;

- The prices displayed on the website and the terms of this policy may change without notice.

Other cases

In all other cases, the Swiss Code of Obligations shall apply.

Applicable law

The customer has been informed that the jurisdiction ("FOR juridique") of Nyon shall apply.

Legal age

THIS SERVICE IS ONLY AVAILABLE TO PERSONS 18 YEARS OF AGE OR OLDER.
